Judge's reasons: Rule 264 states that the Referendum on a Proposal is started thus: once the Proposal has been selected, its Proposer posts the Proposal and the Question (if any) and announces the start of voting. The Proposal may not be modified once it has been selected.

This rule does not mention anywhere else a proposal can go before posting and since it has to be somewhere, it must be in the Pool until such time as it is posted.
